ORANGE LAKE RULES & REGULATIONS
  1. As of January 1, 2025 a Boater Safety Certificate is required for all recreational operators of motorized vessels, including personal watercraft. You can find an online course here.
  2. No mechanically propelled boat shall be operated in a careless manner, or at a speed higher than five (5) miles per hour within a zone which will be bounded by the shoreline, and a line which will be parallel with and three hundred (300) feet from shore line, and marked by suitable markers, provided for and maintained by the ORANGE LAKE HOMEOWNERS’ ASSOCIATION.
  3. Boats operated outside the said zone shall be operated at such a rate of speed as not to endanger the property or person of another, or in any way or in a manner which unnecessarily interferes with the free and proper use of the waters of said lake.
  4. No boat shall be operated at a speed in excess of five (5) miles per hour, within a distance of a hundred fifty (150) feet from another boat.
  5. Motor boat races and regattas are prohibited on Orange Lake.
    4A. Any boat or other vehicle operated on Orange Lake must be owned by and registered to (a) a person who owns real property which is improved with a dwelling and which is contiguous with the shoreline of Orange Lake; (b) a person who has rights to use Orange Lake pursuant to rights conveyed to such person by a deed duly recorded in Orange County Clerk’s Office; or (c) a person who is a Tenant residing in property described in (a) or (b) above.
  6. The exhaust of every engine used on any boat on Orange Lake shall be effectively muffled by equipment so constructed and used as to muffle the noise of the exhaust in a reasonable manner.
  7. The landing upon the surface of Orange Lake by Air Craft is prohibited unless the same is necessary under actual distress conditions.
  8. No person shall drain, deposit or cast any dead animal, offal, excrement, bottles, tin cans, garbage or other putrid or offensive matter in the waters of Orange Lake.7A. The mooring of all sail boats, inboard and outboard motorboats and all vessels designed primarily for travel on water propelled in any manner other than by hand on Orange Lake shall be confined to an area equal to the lake shore frontage of the Property owner, lessee, tenant owning (or allowing) the above-described boats and vessels on Orange Lake shall be limited to the area directly in front of such lake-shore frontage, and within one hundred (100) feet from the shore line as measured by the high-water mark. Exceptions are the areas directly in front of Lots 12 and 13, as designated on map entitled “Orange Lake Park, Town of Newburgh,” prepared by Jargsdorf, dated September, 1940 as revised and filed in Orange County Clerk’s Office on June 26, 1952, and excepting that the area directly in front of lots designated Nos. 552, 553, and 628 on a map entitled “Section 1, Orange Lake Estates, Butler-Fornari Realty Corporation,” prepared by Blake and Woodhull, surveyors, dated March 20, 1928 and filed in the Orange County Clerk’s Office, shall be extended to one hundred fifty (150) feet from the high-water mark.7B. An owner of property which is contiguous with the shoreline of Orange Lake may construct one facility on said lot for the docking or stacking of boats on Orange Lake provided that no such docking or stacking facility shall provide space for the docking or stacking of more than two (2) boats at any time and further provided that no more than one docking or stacking facility shall be constructed for each lot that is contiguous with Orange Lake as said lots appear on the Town of Newburgh tax map as of July 1, 1998. Such docking or stacking facility shall not be of a permanent nature.

    7C. No event sponsored by an individual or organization shall be conducted on Orange Lake without the prior written approval of the Orange Lake Homeowners’ Association. 8. The use of cars or trucks on Orange Lake is strictly prohibited.

NO GUEST BOAT POLICY

Back in 1959, 50 years ago, the Association made a rule against Guest Boats on the lake. The Rule was founded on established law and also on the established fact that Orange Lake is accessed only through private property. To put it another way, there is no public access to Orange Lake.

It was then (and still is) the position of our Association that to protect the lake against an onslaught of public access, our homeowners should not allow others to bring outside boats onto the lake. It was felt that to do so would result in the perception by the public that the lake is open to the public and that would result in overuse of the lake.

You are all aware that Orange Lake is small. It is just a big pond. In fact, before it was known as “Orange Lake” it was called a Machen’s Pond. Now, with the current increased use of jet skis and other personal water craft, its not hard to envision a situation where our use and enjoyment of the lake will be greatly diminished if, for example, 20 crafts are using the lake at one time. And that is very likely to happen if those of us having lake rights permit ‘out of area’ and guest boats.

There are some other practical reasons for the No Guest Boat Rule. First, we want to keep our lake clean and we don’t want crafts coming in from the Hudson River, the Esopus and other bodies of water, which might bring in foreign plant or animal life that will grow and spread in our lake. Also, we want to know who is using the lake for our own protection and for our own safety. We want to be assured that the boats on the lake are legally registered and contain the proper safety equipment and are insured in the event of an accident and that is most likely to be the case when the boats on the lake are owned by those of us who have lake rights.

Also, people coming in from the outside, who may be here for just a few hours, who probably do not know us or care about out welfare or our quality of life, are more likely to operate their crafts in an unsafe and noisy manner. These are just some of the reasons for the No Guest Boat rule. But our biggest fear is overuse and the resulting increased risk of accidents. If that happens, the Town of Newburgh officials may, in the future, either with or without our input, ban the use of either some or all powered watercrafts and the Town has the absolute right to regulate the use of watercraft on Orange Lake.

The Orange Lake Homeowners Association wants you and your guests to use and enjoy Orange Lake. That’s why we all live here — to share our backyard water with our family and our friends.

Now, here is what your Association as asking of you … First, when someone asks your permission to launch their boat or jet ski to the lake, simply tell them that the Lake Association has a rule against outside boats and you are obligated to follow the rule. As an alternative, you can allow them to use your boat or craft.

Secondly, we need YOU to enforce the rule. If you see your neighbor permitting a guest boat, please ask your neighbor if the person has lake rights and ask them if whether he or she is aware of the No Guest Boat rule established by the Association. You can also report it to a member of the Board of Directors and we will send that person a letter. Unfortunately, there is no other way to enforce this rule. We truly need to rely on peer pressure. By following and enforcing the No Guest Boat Rule you will be making a big contribution to continued pleasurable and safe and peaceful use of the lake for yourself and for your neighbors, your children and future generations.
